Feudalism provides fertile soil for weeds of
corruption to grow and grip every institution of the state into their mortal
web. The most sensitive, however, is Judiciary. Put a person with angelic
traits in the chair of a judge, the feudalistic system soon turns him in to a
crook. He openly trades his decisions for money and becomes instrumental in
promoting injustice. Not so in the proposed system which turns a Satan into an
angel. Injustice not only corrupts peoples’ secular life, it also perverts
their spirits. Dispensation of justice, on the other hand, fashions the
material as well as spiritual life of man on sound lines. It creates a happy,
contented and peaceful society that in turn casts salutary effect on nation’s
political environments.
Judiciary is absolutely depoliticized and
independent in its functioning. However, its real power lies in integrity. It
administers justice from minor cases involving individuals to the intricate
ones dealing with institutions and above all the government in power. Justice
is done without undue delay. The contending parties feel convinced that none
has been wronged. Justice lies at the beck and call of each citizen, high or
low, it is also quite inexpensive. This is unimaginable in a feudalistic
system.
At higher levels judiciary interprets country’s
Constitution. Judges are therefore well trained in Muslim Law. When in doubt
they refer the matter to Council of Islamic Jurisprudence. the highest
authority on Fikah. They discharge duties to the best of their abilities
