Rashness:
A rash act is primarily an o’er-hasty act, and ii thus opposed to a deliberate act, but it includes at I thought it may be said to be deliberate, is yet done without deliberation or caution, Criminal ra ss is hazarding a dangerous or wanton act hut without inte1tion to cause injury, or knowledge that it will probably be caused. The criminality lies in running the risk of doing such an act with recklessness and indifference to the consequences. The rush act is done with the consciousness that the mischievous and illegal consequences may follow but with the hope that they will not.
Negligence:
Criminal negligence is the gross and culpable neglect or failure to exercise that reasonable and proper care and caution guard against injury, either to the public generally to an individual in particular, which in the circumstance of the matter, it was the imperative duty of a person to have adopted. Negligence is in to do something which a reasonable man guided by those considerations which ordinarily regulate the conduct of human fears, would do or doing consciousness that the illegal or mischievous effect will follow. It the neglect of the civic duty of circumspection. The punishment for causing the death of a person has been provided in S. 320 of PPC. The offence is punishable, in addition to with imprisonment of either description for a term extending to ten years.
